TO UNDERSTAND THIS POLICY

Map Your City appreciates the interest you have shown in us by visiting our website, mapyour.city, by downloading our app or by subscribing to our Service. We’ll start by getting a few definitions out of the way that should help you understand this policy. When we say “we,” “us,” “our,” and “Map Your City” we’re referring to ANDRS Projects Europe, a Netherlands private limited company, that holds the Map Your City registered trademark. When we say “you”, “user”, “member” or “owner” we’re referring to the person or entity accessing or using the Service.

A “Member” or “Owner” is you or some other person you contact through our Service, or a person who you might choose to contact at some point in the future through the use of our Service. In other words, a Member or Owner is anyone on your Organization’s Member List.

We offer the Service on our websites and through mobile applications. In the course of providing the Service, we may collect Personal Information. “Personal Information” means any information that identifies or can be used to identify you, a User or a Member or Owner, directly or indirectly, including, but not limited to, first and last name, date of birth, email address, gender, occupation or other demographic information. An “Organization Member List” is a list of Members and Owners and all associated information related to those Members and Owners (for example, email addresses).

 

SCOPE OF THIS POLICY AND USING OUR SERVICE

This Privacy Policy is effective with respect to any data that we have collected, or collect, about and/or from you, according to our Terms of Service.

This Privacy Policy describes Map Your City’s policies and procedures on the collection, use and disclosure of your information when you use the Map Your City Service. We will not use or share your information with anyone except as described in this Privacy Policy.

Capitalized terms that are not defined in this Privacy Policy have the meaning given them in our Terms of Service. By accessing or using the Service, you agree to this Privacy Policy.

INFORMATION WE COLLECT

  1. Information You Provide to Us:

Map Your City collects information from you through:

  • Account and product registration and administration of your account
  • The Service that you use
  • Requests or questions you submit to us via forms or email (e.g., support forms, sales forms, user research participation forms)
  • Your communications and dealings with us
  • Your participation in Map Your City sweepstakes, contests, or research studies
  • Uploads or posts to the Service
  • Requests for customer support and technical assistance

Information from and about you: The types of data we collect directly from you may include:

– Name, address, telephone number and email address

– Optional information, such as a photograph, that you elect to associate with your account (your “Profile Information”)

– Log-in details and password, if you create a Map Your City account

– With your permission, certain information stored on your mobile device

– Any email requests or questions you submit to us

– Demographic information such as your gender

– User-generated content you post on the Service

Information about others: If you choose to use our invitation service to invite a friend, Member or Owner to the Service, we will ask you for that person’s email address and automatically send an email invitation. Map Your City stores this information to send this email, to register your friend if your invitation is accepted, and to track the success of our invitation service.

Content: You also provide us information in Content you post to the Service. Your Content and metadata about your Content may be viewed by other users in accordance with your settings on the Service. Map Your City can, but has no obligation, to monitor your Content you post on the Service. We can remove any information you post for any reason or no reason. Map Your City and Map Your City employees will not view Content that is not made viewable in accordance with your settings on the Service, except: (i) to maintain, provide or improve the Service; (ii) to help you and resolve your support requests; or (iii) as Map Your City believes, in its sole opinion, is necessary to comply with or avoid the violation of applicable law or regulation or to cooperate with law enforcement.

Payment Information. If you are a user of our paid premium service, we will utilize a third party credit card payment processing company to collect payment information, including your credit card number, billing address and phone number. The third party service provider, and not Map Your City, stores your payment information on our behalf.

  1. Information We Automatically Collect

When you use our Service that connect to the Internet, including, but not limited to, when you access the Service via our websites, your mobile devices, and Map Your City’s Software, we automatically collect certain information as described in this Section. As discussed further below, we and our service providers (which are third party companies that work on our behalf to provide and enhance the Service) use a variety of technologies, including cookies and similar tools, to assist in collecting this information.

Cookies: When you use the Service, we may send one or more “cookies” – a small data file – to your computer to uniquely identify your browser and let Map Your City help you log in faster and enhance your navigation through the site. A cookie may convey anonymous information about how you browse the Service to us. A persistent cookie remains on your hard drive after you close your browser so that it can be used by your browser on subsequent visits to the Service. Persistent cookies can be removed by following your web browser’s directions. A session cookie is temporary and disappears after you close your browser. You can reset your web browser to refuse all cookies or to indicate when a cookie is being sent. However, some features of the Service may not function properly if the ability to accept cookies is disabled.

Log Files: When you use the Service, our servers automatically record certain information sent by your web browser. These server logs may include information such as your web request, Internet Protocol (“IP”) address, browser type, referring / exit pages and URLs, number of clicks and how you interact with links on the Service, domain names, landing pages, pages viewed, mobile carrier, and other such information.

Clear Gifs Information: When you use the Service, we may employ clear gifs (also known as web beacons) which are used to track the online usage patterns. In addition, we may also use clear gifs in HTML-based emails sent to our users to track which emails are opened by recipients. The information is used to enable more accurate reporting and make Map Your City better for our users.

Geo-Location Information: When you use the Service by or through a mobile device, we may access, collect, monitor and/or remotely store “location data,” which may include GPS coordinates (e.g. latitude and/or longitude) or similar information regarding the location of your mobile device. Location data may convey information about how you browse the Service to us. Location data does not collect or share any personally identifiable information about you. Location data may be used in conjunction with personally identifiable information. Some features of the Service, particularly location-based services, may not function properly if use or availability of location data is impaired or disabled.

Device Identifiers: When you access the Service by or through a mobile device, we may access, collect, monitor and/or remotely store one or more “device identifiers.” Device identifiers are small data files or similar data structures stored on or associated with your mobile device, which uniquely identify your mobile device and are used to enhance the Service. A device identifier may be data stored in connection with the device hardware, data stored in connection with the device’s operating system or other software, or data sent to the device by us. A device identifier may convey information about how you use the Service to us. A device identifier does not collect or share any personally identifiable information about you. A device identifier may be used in conjunction with personally identifiable information. A device identifier may remain persistently on your device, to help you log in faster and enhance your navigation through the Service. Some features of the Service may not function properly if use or availability of device identifiers are impaired or disabled. Map Your City may access, collect and/or store device identifiers upon enabling Map Your City’s Services.

Third Party Tools: Map Your City uses third party analytics tools, such as Google Analytics, to help understand use of the Service. Many of these tools collect the information sent by your browser as part of a web page request, including cookies and your IP address. These analytics tools also receive this information and their use of it is governed by their privacy policy.

 

HOW WE USE & DISCLOSE YOUR INFORMATION

Map Your City uses information we collect to operate, maintain and provide you the features and functionality of the Service that you have requested, to analyze how the Service is used, diagnose service or technical problems, maintain security, personalize content, remember information to help you efficiently access your account, monitor aggregate metrics such as total number of visitors, traffic, and demographic patterns, and track Content and users as necessary to comply with copyright provisions and other applicable laws. Without your information, we cannot provide you with the Services you have requested or you may be limited in your use of the Services.

  1. Reasons to use and disclose Personal Information
  • To promote use of our services to you and others.For example, if we collect your Personal Information when you visit our website and do not sign up for any of the Services, we may send you an email inviting you to sign up. If you use any of our Services and we think you might benefit from using another Service we offer, we may send you an email about that. You can stop receiving our promotional emails by following the unsubscribe instructions included in every email we send. In addition, we may use information we collect in order to advertise our Services to you or suggest additional features of our Services that you might consider using. In addition, we may use your Personal Information to advertise our Services to potential or other users like you.   • To send you informational and promotional content in accordance with your marketing preferences.You can stop receiving our promotional emails by following the unsubscribe instructions included in every email. We may also use your contact information combined with device identifiers to send you in app marketing messages. If you don’t want to receive these messages, you can opt out by unfavoriting Locations or stop following Organizations or turn off notification settings on your mobile device altogether.
  • To bill and collect money owed to us by our Customers.This includes sending you emails, invoices, receipts, notices of delinquency, and alerting you if we need a different credit card number. We use third parties for secure credit card transaction processing, and we send billing information to those third parties to process your orders and credit card payments.
  • To send you System Alert messages.For example, we may inform you of temporary or permanent changes to our Service, such as planned outages, new features, version updates, releases, abuse warnings, and changes to our Privacy Policy.
  • To communicate with you about your account and provide customer support.
  • To enforce compliance with our Terms of Service and applicable law.This may include developing tools and algorithms that help us prevent violations.
  • To protect the rights and safety of our users and third parties, as well as our own.
  • To meet legal requirements,including complying with court orders, valid discovery requests, valid subpoenas, and other appropriate legal mechanisms.
  • To provide information to representatives and advisors, including attorneys and accountants, to help us comply with legal, accounting, or security requirements.
  • To prosecute and defend a court, arbitration, or similar legal proceeding.
  • To respond to lawful requests by public authorities, including to meet national security or law enforcement requirements.
  • To provide, support, and improve the Service we offer.This includes our use of the data that our Customers provide us in order to enable our Customers to use the Service to communicate with their Members, Owners and fans following their Organization (“Followers”). This also includes, for example, aggregating information from your use of the Service or visit to our websites and sharing this information with third parties to improve our Service. This might also include sharing your information or the information you provide us about your Members and Owners with third parties in order to provide and support our Service or to make certain features of the Service available to you. When we do have to share Personal Information with third parties, we take steps to protect your information by requiring these third parties to enter into a contract with us that requires them to use the Personal Information we transfer to them in a manner that is consistent with this policy.
  • To provide suggestions to you.This includes adding features that compare Customers’ engagement campaigns, using data to suggest other publishers or communities you, your Members, Owners or Followers may be interested in, or using data to suggest locations, products or services that you may be interested in or that may be relevant to you or your Members, Owners and Followers. Some of these suggestions are generated by use of our Map Your City Labs.   • To transfer your informationin the case of a sale, merger, consolidation, liquidation, reorganization, or acquisition. In that event, any acquirer will be subject to our obligations under this Privacy Policy, including your rights to access and choice. We will notify you of the change either by sending you an email or posting a notice on our Website.
  1. How we disclose Personal Information

Your Use: We will display your Personal Information in your profile page and elsewhere on the Service according to the preferences you set in your account. Any information you choose to provide should reflect how much you want others to know about you. Please consider carefully what information you disclose in your profile page and your desired level of anonymity. You can review and revise your profile information at any time. We may also share or disclose your information with your consent, for example if you use a third party application to access your account (see below).

Your name, email address and other information you choose to provide on the Service – such as a photograph, that you elect to associate with your account profile – will be viewable and discoverable by other users, in accordance with your settings on the Service.

We may use your email address to send you Service-related notices (including any notices required by law, in lieu of communication by postal mail). We may also use your contact information combined with device identifiers to send you marketing messages. If you don’t want to receive these messages, you can opt out by following the instructions in the message or turn off notification settings on your mobile device. If you correspond with us by email, we may retain the content of your email messages, your email address and our responses.

Service Providers, Business Partners, and Others: Map Your City may share your personally identifiable information with other third parties for the purpose of providing the Service to you. If we do this, such third parties’ use of your information will be bound by this Privacy Policy. We may also store personal information in locations outside the direct control of Map Your City (for instance, on servers or databases co-located with hosting providers).

Business Transfers: As we develop our business, we may buy or sell assets or business offerings. Customers, email, and visitor information is generally one of the transferred business assets in these types of transactions. We may also transfer or assign such information in the course of corporate divestitures, mergers, or dissolution.

Third Party Services: We may share your information with a third party application with your consent, for example when you choose to access our Service through such an application. We are not responsible for what those parties do with your information, so you should make sure you trust the application and that it has a privacy policy acceptable to you.

Compliance with Laws and Law Enforcement Requests; Protection of Map Your City’s Rights: Map Your City may disclose your personal information if required to do so by law or subpoena or if we believe that it is reasonably necessary to comply with a law, regulation or legal request; to protect the safety of any person; to address fraud, security or technical issues; or to protect Map Your City’s rights or property.

Non-Personally Identifiable Information: We may disclose your non-private, aggregated, or otherwise non-personally identifiable information, such as anonymous usage data, platform types, etc., with interested third parties to help them understand the usage patterns for certain Map Your City Services.

Combined Information: We may combine Personal Information with other information we collect or obtain about you (such as information we source from our third party partners), to serve you specifically, such as to deliver a product or service according to your preferences or restrictions, or for advertising or targeting purposes in accordance with this Privacy Policy. When we combine Personal Information with other information in this way, we treat it as, and apply all of the safeguards in this Privacy Policy applicable to, Personal Information.

DATA COLLECTED FOR AND BY OUR CUSTOMERS’ ORGANIZATIONS

As you use our Service, you may import into our system Personal Information you have collected from your Members, Owners or other individuals. Members and Owners as users of the Service opt in upon accepting your invitation request to the Service and their use of the Service is governed by the Terms. Consistent with the uses of Personal Information, we may transfer Personal Information of you or your Members or Owners to companies that help us promote, provide, or support our Service or the services of our Customers (“Service Providers”). All Service Providers enter into a contract with us that protects Personal Information and restricts their use of any Personal Information consistent with this policy. As part of our Service, we may use and incorporate into features information you have provided, we have collected from you, or we have collected about Members or Owners. We may share this information, including Member & Owner email addresses, with third parties in line with the approved uses.

If you are a Member or Owner and no longer want to be contacted by one of our Customers’ Organizations or no longer want to experience the benefits of being an Organization Member, you can either unfollow an Organization or be disconnected from an Organization. To be disconnected from an Organization please unsubscribe as Member or Owner from that Organization or contact the Organization directly to request to update or delete your Personal Information. If you contact us, we may remove or update your information within a reasonable time and after providing notice to the Customer’s Organization of your request.

We will retain Personal Information we process on your behalf of on behalf of our Organizations for as long as needed to provide our Service or to comply with our legal obligations, resolve disputes, prevent abuse, and enforce our agreements.

 

PUBLIC INFORMATION AND THIRD PARTY WEBSITES

(a) Locations. Some areas of the Service allow you to post or upload information, text, graphics, or other material connected to Locations. When posting Content – such as information about a Location as a Member or Owner or information you include in a comment on our Locations as a user – it may be read, collected, and used by anyone. If your Personal Information appears in relation to Locations and you want it removed, contact us here. If we are unable to remove your information, we will tell you why.

(b) Social media platforms and widgets. Our Service includes social media features, such as the Facebook Share button. These features may collect information about your IP address and which page you are visiting on our Service, and they may set a cookie to make sure the feature functions properly. Social media features and widgets are either hosted by a third party or hosted directly on our Service. We also maintain presences on social media platforms including Facebook, Twitter, and Instagram. Any information, communications, or materials you submit to us via a social media platform is done at your own risk without any expectation of privacy. We cannot control the actions of other users of these platforms or the actions of the platforms themselves. Your interactions with those features and platforms are governed by the privacy policies of the companies that provide them.

(c) Links to third-party websites. Our Service includes links to other websites, whose privacy practices may be different from ours. If you submit Personal Information to any of those sites, your information is governed by their privacy policies. We encourage you to carefully read the privacy policy of any website you visit.

 

HOW WE PROTECT YOUR INFORMATION

The security of your information is important to us. When you enter sensitive information (such as a credit card number) as part of our service, we encrypt the transmission of that information using secure socket layer technology (SSL).

Map Your City uses commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of your personal information, once we receive it. For example, we continuously and regularly back up your data to help prevent data loss and aid in data recovery. We also guard against common web attack vectors, host data in secure ISO9001, ISO27001, and SSAE16 Type II certified data centers of Digital Ocean in Amsterdam, and implement firewalls and access restrictions on our servers to secure our network and better protect your information. No method of electronic transmission of storage is 100% secure, however, and we cannot ensure or warrant the absolute security of any information you transmit or store in the Service.

In the event that personal information is compromised as a result of a breach of security, Map Your City will promptly notify those persons whose personal information has been compromised, in accordance with the notification procedures set forth in this Privacy Policy, or as otherwise required by applicable law.

Map Your City accounts require a username and password to log in. You must keep your username and password secure, and never disclose it to a third party. Your account passwords are encrypted, which means we cannot see your passwords. We cannot resend forgotten passwords either. We will only reset them.

YOUR CHOICES ABOUT YOUR INFORMATION

You may, of course, decline to submit personally identifiable information through the Service, in which case Map Your City may not be able to provide certain services to you. You may update or correct your account information at any time by logging in to your account.

We also provide you with a number of choices with respect to the information we collect and use as discussed throughout this Privacy Policy. For example:

– You may instruct us not to use your contact information to contact you by email, postal mail or phone regarding products, services, promotions and special events that might appeal to your interests by contacting us. In commercial email messages, you can also opt out by following the instructions located at the bottom of such emails. Please note that, regardless of your request, we may still use and share certain information as permitted by this Privacy Policy or as required by applicable law. For example, you may not opt out of certain operational or service-related emails, such as those reflecting our relationship or transactions with you.

– Depending on whether you are using our free services, or are a user of a paid premium account that belongs to you or a Customer, you will have certain choices through your account interface or through your mobile device’s operating system, to opt-out of receiving categories of notices as part of the Service.

 

MAP YOUR CITY BLOG & COMMUNITY

Our Service offers publicly accessible community services including blogs, and forums. You should be aware that any information you provide in these areas may be read, collected, and used by others who access them. Your posts may remain even after you cancel your account.

 

CHILDREN’S PRIVACY

Protecting the privacy of young children is especially important. Our Service is not directed to persons under 16. Map Your City does not knowingly collect or solicit personal information from anyone under the age of 16 or knowingly allow such persons to register with the Service. If we become aware that we have collected personal information from a child under age 16 without verification of parental consent, we take steps to remove that information. If you believe that we might have any information from or about a child under 16, please contact us at privacy@mapyour.city.

 

INTERNATIONAL DATA TRANSFER

As an international company, we may transfer and access Personal Information from around the world, including between and from within the European Union and the United States. Map Your City aims to maintains strong data protection and privacy controls to protect your Personal Information and to ensure its security during international transfer and any periods of storage in foreign locations.

 

THIRD PARTY SERVICES & EU PRIVACY FRAMEWORKS

When we employ other parties to perform functions on our behalf these parties may be located in the EU/EEA or the United States of America (“USA”). Any party employed by us that is located in the USA complies with the EU-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union to the United States. We may share some of your information with these service providers in order for them to provide their services, analyzing data, providing marketing assistance, conducting customer and/or user profiling, and providing customer service. As such, the terms and privacy policies of these service providers may apply to you as well, in particular: Google AnalyticsGoogle AdwordsGoogle Tag ManagerGoogle Recaptcha, Helpscout, MailChimp. Acceptance of these service provider terms is required to access the website and Service. Further information is set out below in our Cookie Statement

Map Your City seeks to conclude data processing agreements with each service provider before third party services are implemented into the website or Service in order to ensure that your Personal Information is used, stored, and transferred securely and in accordance with European Union law. Even so, Map Your City does not control or assume any responsibility for the content or practices of these service providers, including their data storage and transfer policies, and this Privacy Policy does not apply to these features, which are governed by their own policies and terms.

 

ACCESS

We will give an individual, either you or a Member or Owner, access to any Personal Information we hold about them within 30 days of any request for that information. Individuals may request to access, correct, amend or delete information we hold about them by contacting us here. Unless it is prohibited by law, we will remove any Personal Information about an individual, either you or a Member or Owner, from our servers at your or their request. There is no charge for an individual to access or update their Personal Information.

 

CHANGES TO OUR PRIVACY POLICY

If we change our Privacy Policy, we will post those changes on this page to keep you aware of what information we collect, how we use it and under what circumstances we may disclose it. Changes to this Privacy Policy are effective when they are posted on this page.
